NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. OPEN TO LEGAL RESIDENTS OF CANADA (EXCLUDING QUEBEC) AND THE CONTIGUOUS UNITED STATES (EXCLUDING ALASKA, HAWAII, AND TERRITORIES AND POSSESSIONS).VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
By entering, you waive (i) any right to claim punitive, incidental, consequential or any other damages, other than out-of-pocket expenses; (ii) any right to resort to any form of class action; and (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event will entrant be entitled to receive attorney’s fees or other legal costs.
1. SWEEPSTAKES DESCRIPTION: The Saje Natural Business, Inc. Aroma (Be) Free Sweepstakes ("Sweepstakes") begins on August 16, 2021 at 12:00am PST and ends on August 18, 2021 at 11:59pm PST (the "Entry Period"). The sponsor of the Sweepstakes is Saje Natural Business, Inc. ("Sponsor"). By participating in the Sweepstakes, each Entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Sponsor, which shall be final and binding in all respects. Sponsor is responsible for the collection, submission and processing of Entries and the overall administration of the Sweepstakes. Entrants should look solely to Sponsor with any questions, comments or problems related to the Sweepstakes. Sponsor may be reached by email at hello@saje.com.
2. ELIGIBILITY: Open to legal residents of Canada (excluding Quebec) and the contiguous United States (excluding Alaska, Hawaii, and territories and possessions) who are 18 years old or older, or have reached the age of majority in their Province or Territory (Canada), or State (United States) of residence as of the date of entry (the "Entrant"). Void where prohibited. All federal, provincial, state and local laws and regulations apply. Sponsor, its affiliates, subsidiaries, vendors and agents, and their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, directors, employees, successors and assigns (the "Sweepstakes Entities"), and employees of Sponsor or the Sweepstakes Entities, and the immediate family members (herein, defined as spouse, siblings, children and each of their respective spouses, regardless of residence, and any person living in such a person's household, whether related or not), of the foregoing, are ineligible to enter the Sweepstakes or win a prize.
3. HOW TO ENTER: Visit the Saje Wellness website during the Entry Period at https://www.saje.com/aroma-be-free. Provide your name and email address on the contest entry form and click “enter here” to submit your entry for a chance to win. Limit one (1) entry per person. All Entries must be submitted online by the end of the Entry Period to be included in the random drawing. Sponsor's database clock will be the official timekeeper for this Sweepstakes. Odds of winning depend on the number of eligible Entries received.
4. PRIZES: Prize: One hundred (100) winners each will receive one (1) cosmic blue Aroma (Be) Free diffuser from Saje Wellness. Approximate Retail Value or “ARV” for each prize: $118. Total ARV for all prizes: $11,800. ARV is in USD for US residents, and CDN for Canadian residents. Only one (1) prize per person and per household will be awarded. Prizes cannot be transferred, redeemed for cash or substituted by winner. Sponsor reserves the right in its sole and absolute discretion to award a substitute prize of equal or greater value if a prize is unavailable or cannot be awarded, in whole or in part, for any reason. The ARV of the prize represents Sponsor's good faith determination. That determination is final and binding and cannot be appealed. If the actual value of the prize turns out to be less than the stated ARV, the difference will not be awarded in cash. Sponsor makes no representation or warranty concerning the appearance, safety or performance of any prize awarded. Prizes must be claimed in accordance with these Official Rules. Restrictions, conditions, and limitations may apply. Sponsor will not replace any lost or stolen prize items. All federal, provincial, state and/or local taxes, fees, customs and surcharges are the sole responsibility of the prize winner. Failure to comply with the Official Rules may result in forfeiture of the prize.
5. WINNER SELECTION: The Winner(s) of the Sweepstakes will be selected in a random drawing from among all eligible Entries received during the Entry Period. The random drawing will be conducted on or about August 19, 2021 by Sponsor or its designated representatives, whose decisions are final and binding. Odds of winning depend on the number of eligible Entries received.
6. WINNER NOTIFICATION: Potential winner(s) will be notified approximately 24 hours after the random drawing through an e-mail sent to the Entrant’s e-mail address provided in the Entry. Sponsor is not responsible for any delay or failure to receive notification for any reason, including without limitation inactive email account(s), technical difficulties associated therewith, or any potential winner’s failure to adequately monitor any email account. Any potential winner notification not responded to or returned as undeliverable may result in prize forfeiture. Potential winners may be required to sign and return an affidavit of eligibility and release of liability, and a publicity release (collectively "the Affidavit") within ten (10) days of receipt of the potential winner notification. Final eligibility for the award of any prize is subject to eligibility verification as set forth below. If any potential winner is disqualified, Sponsor shall select and notify another potential winner in the same manner as above. No substitution or transfer of a prize is permitted except by Sponsor.
7. PRIZE DELIVERY: After all winners have been confirmed, confirmed winners will be sent, via email to the winner’s email address provided in the Entry, a unique coupon code to claim their prize online at https://www.saje.com/aroma-be-free-cosmic-blue-708752. Winners will add the item to their basket, enter the coupon code, and check out to claim their prize. Prizes must be claimed online by December 31, 2021, after which the coupon code will expire. Approximately five (5) days from the date the winner claims the prize, the prize will be mailed out (shipping and handling provided by Sponsor) to the address provided by the confirmed winner in the Entry, provided that prizes will be delivered only to addresses within Canada (excluding Quebec) and the contiguous United States (excluding Alaska, Hawaii, and territories and possessions). Sponsor is not responsible for any returned or undeliverable prize and such prize will be forfeited.
8. PRIVACY AND COMMUNICATIONS: Any personal information supplied by you in connection with the Sweepstakes will be subject to the privacy policy of the Sponsor posted at https://www.saje.com/privacy-policy.html. By entering the Sweepstakes, you grant Sponsor permission to use and share your email address and any other personally identifiable information with the Sweepstakes Entities only for the purpose of administration and prize fulfillment. Entry in this Sweepstakes constitutes each entrant’s consent to receipt of email and other communications from Sponsor regarding the Sweepstakes, and receipt of promotional email from Sponsor concerning Saje products. By accepting a prize, winners agree to use of their name and location by Sponsor and its designees in announcing the winners of the Sweepstakes.
9. LIMITATION OF LIABILITY: Sponsor assumes no responsibility or liability for (a) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (b) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes; (c) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Sweepstakes; (d) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (e) suspended or discontinued Internet, wireless or landline phone service; or (f) any injury or damage to participant's or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Sweepstakes or download of any materials in the Sweepstakes. In the event of a conflict between promotional materials about this Sweepstakes and these Official Rules, these Official Rules will control. If, for any reason, the Sweepstakes is not capable of running as planned for reasons which may include, without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, the Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes in whole or in part, including any random drawing or prize award. Sponsor reserves the right to award any remaining prizes (up to the total ARV as set forth in these Official Rules) in Sponsor’s sole discretion. Sponsor and Sweepstakes Parties shall not have any further liability to any participant, entrant or potential winner in connection with the Sweepstakes
10. RELEASE AND INDEMNIFICATION: By participating in the Sweepstakes, each Entrant agrees that Sponsor and the Sweepstakes Entities have no liability or responsibility and are hereby released from any liability or responsibility for any injuries, loss or damage of any kind, including without limitation personal injury or death, resulting from participation in the Sweepstakes, acceptance, possession or use of a prize, use of the winner’s name or location, or any activity related to any of the foregoing (together, the “Activities”), including without limitation claims unknown when this release is entered; and further agree to indemnify, defend and hold harmless Sweepstakes Entities from any claims, liability, damage, loss, injury or death to persons or property caused or claimed to be caused, in whole or in part, directly or indirectly, by any of the Activities. Without limitation each Entrant expressly waives and relinquishes all rights and benefits under Section 1542 of the Civil Code of California, and any similar law or common law principle of similar effect in any jurisdiction with respect to the claims release herein. Section 1542 reads as follows: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
11. DISPUTES: These Official Rules shall serve as an agreement between each Entrant and Sponsor, and shall be governed by, and construed in accordance with, the laws of Canada (excluding Quebec) for participants residing in Canada, and the laws of the State of California, USA for participants residing in the United States (excluding Alaska, Hawaii, territories and possessions), without regard to its conflict of law provisions. The sole and exclusive forum and venue for any dispute for Canadian residents shall be in Vancouver, British Columbia. The sole and exclusive forum and venue for any dispute for US residents shall be in Valencia County, California. By entering, entrants agree that (i) under no circumstance may entrant obtain an award for, and entrant hereby waives all right to claim, punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; (ii) all causes of action arising out of or connected with the Sweepstakes or any prize shall be resolved individually, without resort to any form of class action; and (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, but in no event will entrant be entitled to receive attorney’s fees or other legal costs.
12. ENTIRE AGREEMENT: These Official Rules and any Affidavit serve as an agreement with Sponsor and reflect the entire understanding between entrants and Sponsor concerning the Sweepstakes and the subject matter hereof. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision, which will remain in effect and will be construed in accordance with its terms as if the invalid or illegal provision were not contained herein. Sponsor’s failure to enforce any term will not constitute a waiver of that term or any other term. No modification or waiver of the terms shall be effective unless made in a writing signed by all parties.
13. WINNER'S LIST: For a winners’ list or copy of these Official Rules, send a self-addressed stamped envelope with your request to Saje Natural Business Inc., 500 - 22 East 5th Avenue, Vancouver, BC V5T1G8 Canada, Attention: The Saje Natural Wellness Sweepstakes. Winners’ list will be available on or about February 28, 2021.
